What is mediation? Mediation is a facilitated, non-adversarial process for reaching a mutually acceptable agreement based on the self-determined needs, interests, priorities, and values of the parties.
What is the role of a mediator? The mediator is a neutral third party that assists the parties in developing their informed and voluntary decisions and, ideally, settlement. Unlike a judge, a jury, or an arbitrator, the mediator is not a decision-maker. Rather, the role of the mediator is to assist the parties in reaching their own agreement or settlement of the dispute. The mediator is an advocate for the process, not for any particular party.
Why should I choose mediation? Consider that mediation is often less expensive and time consuming than court proceedings, that with only a few exceptions, the mediation proceedings and materials are confidential, and that mediation promotes self determination.
Do I need to have a lawyer? Mediation does not require a lawyer. Since mediators cannot give legal advice, parties are encouraged to consult with legal counsel at any time, including for review of the settlement before signing.
Do I have to appear in person? Mediations can be effectively conducted in person or virtually, via videoconference. The mediator will work with the parties to ensure a convenient and neutral environment that supports her impartiality and facilitates settlement.
Who is the Neal Firm mediator? Karama Neal, PhD, lead mediator, is a certified mediator for the Arkansas Circuit Courts, Civil and Probate Division. With her private mediation clients, Dr. Neal works nationally and virtually, to resolve a variety of issues, including family land and property disputes given her long term work on heirs property.
